If the customer arranges the freight, the terms FCA apply, i.e., ABAS’s responsibility applies until the goods are loaded onto the vehicle. The buyer must then ensure that they have the correct insurance coverage. However, if ABAS arranges the freight, the terms DAP apply, i.e., ABAS is responsible for and insures the goods during transport to the customer. The risk passes to the buyer when the goods are unloaded. Therefore, it is important that the buyer ensures they have adequate insurance coverage for unloading.

The goods must be inspected upon arrival, and any damage must be noted on the consignment note in accordance with the freight company’s complaint procedures. If the required inspection is not carried out, the customer is not entitled to assert a claim against ABAS.

Acceptance of the product takes place upon delivery or commissioning. If the customer is not present at commissioning and does not sign the acceptance, the product will be inspected by ABAS’s installer. This document is then saved in dox.abas.se. The warranty period begins on the date of acceptance.

Even when ABAS is responsible for commissioning and assembly, it is the customer’s responsibility to ensure that the product is secured appropriately upon delivery so that no damage to the product can occur before commissioning has taken place. It is particularly important to ensure that gates cannot overturn due to soft ground or windy weather, etc.
All motorized products must be maintained and serviced in accordance with ABAS’s instructions, otherwise the warranty will not apply.

ABAS recommends carrying out a service within 6 months after commissioning. We know from experience that the gate will have a longer lifespan if an adjustment and tightening of bolts is carried out some time after the gate has settled.

ABAS has an enhanced warranty commitment, in addition to what is stated in NL 17 and NLS 19.

ABAS is not responsible to third parties for costs caused by the defect, such as hired guards, travel expenses or working hours.

In order for loop cutting to be carried out with good results and for full function to be achieved, the surface must be asphalted and relatively dry. It is the customer’s responsibility to ensure that loop cutting is possible. ABAS understands that this requirement may be difficult to meet in the event of heavy rain, for example.
In cases where loop cutting is not suitable, ABAS will decide not to carry it out, based on experience-based knowledge that the function will not be fully satisfactory. This may involve extra costs for ABAS customers due to extra travel, etc. However, ABAS considers these costs to be lower than if loop cutting had been carried out with reduced function.

In the event of cancellation of purchase, the Swedish Contract Act 2020 applies. Sometimes, for goodwill reasons, ABAS agrees to give the customer a somewhat greater opportunity for cancellations, returns, etc., even though approved cancellation is not fulfilled according to the Contract Act. However, ABAS never credits more than 80%, and this only applies if the goods are in perfect condition. If the goods are unique to their character, cancellation is usually not possible; an individual assessment is made in these cases.
